By accessing or using the Rusken Charitable Foundation (“we,” “us,” or “our”) website and services (the “Site”), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any part of these terms, you may not access the Site or use our services.

2. Donations & Payment Processing

2.1 Donations

All donations made through our Site are final and non-refundable, except as required by applicable law.

2.2 Payment Gateways

We use third-party payment processors (e.g., M-Pesa, banks) to handle transactions. You agree to their respective terms, fees, and privacy policies when donating.

2.3 Tax Receipts

Upon successful donation, we will issue a tax receipt via email within seven (7) business days, provided valid contact information is supplied.

3. User Accounts

If you register for an account (e.g., volunteer or donor portal), you are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use or security breach.

4. Prohibited Conduct

You agree not to:

• Use the Site for any unlawful purpose or to infringe on any intellectual property rights.
• Transmit viruses, malware, or any harmful code.
• Harvest or collect personal data about other users without consent.

5. Intellectual Property

All content on the Site, including text, graphics, logos, and software, is the property of Rusken Charitable Foundation or its licensors and is protected by copyright and trademark laws. You may not reproduce, modify, or distribute any content without our express written permission.

The Site and all content are provided “as is” without warranties of any kind, express or implied, including merchantability or fitness for a particular purpose. We do not warrant uninterrupted or error-free operation of the Site.

7. Limitation of Liability

In no event shall Rusken Charitable Foundation or its officers be liable for any indirect, incidental, special, or consequential damages arising out of your use or inability to use the Site, even if advised of the possibility of such damages. Our total liability to you for any claim arising under these Terms shall not exceed the total amount of donations you made in the twelve (12) months preceding the claim.

8. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of Kenya, without regard to conflict of law principles. Any dispute arising under or in connection with these Terms shall be resolved exclusively by the courts located in Nairobi, Kenya.

9. Modifications to Terms

We reserve the right, at our sole discretion, to modify these Terms at any time. The revised Terms will be effective upon posting on the Site, and your continued use of the Site constitutes acceptance of those changes.
